Public examination

In accordance with FEDERAL LAW No. 172-FZ “ON ANTI-CORRUPTION EXAMINATION OF REGULATORY ACTS AND THEIR DRAFTS” dated July 17, 2009 the examination of regulatory acts and of other documents to reveal any provisions contributing to creating conditions for corrupt practices (hereinafter, examination as to propensity for corruption) is conducted in respect to:

  • draft federal laws, Decrees of the Russian Federation, government decrees of the Russian Federation developed by federal executive bodies,
  • draft regulatory acts of the federal executive bodies addressing the rights, freedom and obligations of men and citizens,
  • draft regulatory acts of the federal executive bodies specifying a legal status of organizations or of inter-authority nature,
  • conceptual designs and draft assignments for development of draft federal laws,
  • draft federal laws submitted for preparation of draft official opinions of the Government of the Russian Federation related to draft federal laws as well as draft amendments of the Government of the Russian Federation to federal laws.

Civil Society Institutes and citizens may, from their own funds and according to the procedure established by the regulatory acts of the Russian Federation, conduct an independent anti-corruption examination of regulatory acts (drafts of regulatory acts). Examination as to propensity for corruption is carried out by individuals and corporate persons (independent experts) properly accredited by the Ministry of Justice of the Russian Federation, which adopted the resolution about its conduction in accordance with the procedure for examination of draft regulatory acts and other documents.

The independent examination as to propensity for corruption is carried out on own initiate and from own funds.

An expert opinion is made following the results of the independent examination as to propensity for corruption, which shall be forwarded to the federal executive body, the draft document developer.

The opinion following results of the independent anti-corruption examination shall contain corruptogenic factors revealed in the regulatory acts (draft regulatory acts) and suggestions for their correction.

The opinion following results of the independent anti-corruption examination is of recommendation nature and subject to obligatory consideration by a receiving body, organization or an officer, within a 30-day period after its receipt. Following the results of consideration, a citizen or a organization which conducted the examination shall be provided with a substantiated response, except where the opinion has no suggestions as to the remedy for the corruptogenic factors revealed.

In order to conduct an independent examination, please apply to an appropriate regional Office of Association of Lawyers of Russia. The below Offices have Accreditation Certificates of a Regional Office of Association of Lawyers of Russia as independent experts authorized to conduct examination as to propensity for corruption of draft regulatory documents and of other documents:

On September 26, 2011 as part of Chairman of the Board of Association of Lawyers of Russia Igor Manylov's first official visit to the Republic of Korea was held a work meeting with Board of leading South Korean Law Firm “YULCHON” Sai Ree Yun and Bong Hee Han. During the meeting, sides discussed matters of developing partnership between legal organizations, possibility of signing Cooperation Agreement between All-Russian Non-commercial Organization “Association of Lawyers of Russia” and South Korean Law Firm “YULCHON”, as well as existing practice of evaluation and certification of lawyers in both countries.
